Rereading remarriage with a view to the purposes of Sharia

Forming and consolidating the family is one of the essential purposes of the Islamic religion, and the Islamic legislator must consider the individual and social interest of people when discovering and enacting laws. However, it seems that some of the existing laws in the field of family are not in line with these principles in Islam and create the basis for weakening the strength of the family and, as a result, increasing tension in the society. One of these legal articles is the discussion of polygamy. The purpose of this article is to provide the conditions for modern interactions in jurisprudence and legal institutions in order to adapt to the conditions and requirements of the time and adjust the remarriage law and adapt its foundations and principles to the time-spatial necessities, with the analytical-inferential method and with the library method. It seeks to provide operational solutions to amend legal articles related to polygamy based on the purposes of Sharia; In this regard, the principles, rules and general purposes in family law have been analyzed and finally the alignment of the existing laws with the principles of the Shari'a purposes has been analyzed. Finally, some suggestions have been provided for the amendments of the article in question.
